Lack of Informed Consent

In Maryland, a physician (dentist) is required to share with their patient the alternative options for care and treatment and to discuss with the patient the risks and benefits of different procedures to consider. If the doctor fails to share this information and the patient suffers an injury, the lack of informed consent claim would apply for injuries sustained.

In a recent case, we obtained a $1.5 million verdict because the dentist failed to explain the risks of surgery they recommended, which likely was not necessary, and during which the patient suffered a permanent injury.
